Terms of Use and End User License Agreement (EULA)
1. Introduction
Welcome to Spark Rituals.
These Terms of Use and End User License Agreement ("Terms") govern your access to and use of all mobile applications, websites and related services offered under the Spark Rituals brand.
Spark Rituals is operated by Storm Advies B.V., a Dutch private limited company (besloten vennootschap), registered with the Netherlands Chamber of Commerce (KVK) under number 78745128, with its registered office at Heerlerweg 122, 6367 AG Voerendaal, The Netherlands.
Spark Rituals is a trade name (handelsnaam) of Storm Advies B.V.; it is not a separate legal entity.
Throughout these Terms:
"Spark Rituals," "we," "our," and "us" refer to Storm Advies B.V.
"you" refers to the individual who downloads, installs or uses one of our applications.
These Terms apply to all current and future Spark Rituals applications, including but not limited to:
Little Lines
Stay Close
Daily Talk
unless a separate agreement expressly states otherwise.
By downloading, installing, accessing or using any Spark Rituals app, you agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use our apps.
2. Acceptance of these Terms
By accessing or using a Spark Rituals app, you confirm that:
you have read these Terms;
you understand these Terms;
you agree to be legally bound by these Terms;
you have the legal capacity to enter into this agreement; and
you will comply with all applicable laws while using the apps.
If you are accepting these Terms on behalf of another person or organisation, you represent that you have authority to do so.
3. Definitions
For purposes of these Terms:
App means any mobile application published under the Spark Rituals brand.
Apple means Apple Inc. and its affiliated companies that operate the App Store, StoreKit, CloudKit and related Apple services.
Content means information entered by you into the apps, including memories, quotes, notes, photographs, conversations, journal entries and other materials.
Device means an Apple device on which the app is installed.
Free Features means features available without a paid subscription.
Premium Features means features available only through an active Apple In-App Purchase subscription.
Subscription means an auto-renewable subscription purchased through Apple's App Store.
User Content means any content that you voluntarily create, enter or store within a Spark Rituals app.
4. About Spark Rituals
Spark Rituals develops privacy-focused applications designed to help parents capture meaningful family memories and encourage positive family interactions.
Unlike many online services, Spark Rituals has been intentionally designed using a local-first architecture.
This means that the memories, notes and other content you create remain stored on your own Apple device and, where enabled, within your own iCloud account.
Storm Advies B.V. generally does not receive, access or store your personal memories on its own servers.
Our apps are intended to support families by providing useful digital tools while respecting your privacy.
5. Eligibility and Intended Users
Spark Rituals apps are intended for use by adults.
The apps are designed primarily for parents, guardians and other adult caregivers.
You must be at least the age required under the laws of your country to enter into a legally binding agreement.
Children are not the intended users of the apps.
Parents remain solely responsible for determining what information they choose to record about their children.
By using the apps, you represent that you satisfy these eligibility requirements.
6. Local-First Service and No User Accounts
Spark Rituals has been designed to operate without requiring you to create an account with us.
At launch:
no Spark Rituals user account is required;
no registration is required;
no password is required for access to our services;
your content remains stored locally on your device and, if enabled, within your personal iCloud account.
Because we do not maintain user accounts:
we cannot access your stored memories;
we cannot recover deleted content;
we cannot reset your Apple ID credentials;
we cannot transfer your data between Apple accounts.
You are responsible for maintaining access to your Apple device, Apple ID and iCloud account.
7. License to Use the Apps
Subject to these Terms and your continued compliance with them, Storm Advies B.V. grants you a limited, personal, non-exclusive, non-transferable and revocable licence to download, install and use the Spark Rituals apps solely for your own personal, non-commercial use.
This licence does not transfer ownership of the apps or any intellectual property rights to you.
Except as expressly permitted by applicable law, you may not:
copy, reproduce or distribute the apps;
sell, sublicense, lease or rent the apps;
modify, adapt or create derivative works from the apps;
reverse engineer, decompile or attempt to discover the source code of the apps;
circumvent or interfere with security features or technological protection measures;
use the apps in any unlawful manner; or
use the apps in a manner that could damage, disable or impair our services.
Any rights not expressly granted in these Terms are reserved by Storm Advies B.V.
8. Apple App Store Terms
The Spark Rituals apps are distributed exclusively through Apple's App Store.
By downloading or using the apps, you also agree to comply with Apple's applicable terms and conditions, including the Apple Media Services Terms and Conditions and any App Store policies that apply to your use of the apps.
These Terms govern the relationship between you and Storm Advies B.V. Apple is not a party to these Terms and is not responsible for the apps except as required by applicable law.
You acknowledge and agree that:
Apple has no obligation to provide maintenance or support services for the apps.
Apple is not responsible for addressing claims relating to the apps, including product liability claims, consumer claims, regulatory claims or claims that the apps fail to comply with applicable legal requirements.
Apple is not responsible for investigating, defending, settling or discharging any claim that the apps or your use of them infringe a third party's intellectual property rights.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you where applicable.
Nothing in these Terms limits any rights you may have under Apple's own agreements or applicable consumer protection laws.
9. Subscriptions and Billing
9.1 Free and Premium Features
Spark Rituals offers both free and premium features.
Certain features are available without charge, while additional features may require an active subscription purchased through Apple's App Store.
The features included in each subscription tier may change from time to time as the apps evolve.
9.2 Apple In-App Purchases
All subscriptions are purchased exclusively through Apple's In-App Purchase system (StoreKit).
Storm Advies B.V. does not process payments directly.
We do not receive or store your payment card information, bank account information or other payment credentials.
Apple is solely responsible for processing payments, charging your selected payment method and issuing receipts.
9.3 Subscription Plans
Spark Rituals may offer different subscription plans for different applications and regions.
Subscription options, billing periods, available features, free trials, introductory offers and renewal terms may vary between our apps and may change from time to time.
Current pricing, subscription options and any applicable introductory offers are displayed within the Apple App Store before you complete your purchase.
Pricing is determined through Apple's App Store pricing system and may vary depending on your country, currency, applicable taxes and Apple's regional pricing tiers.
The price shown to you before purchase is the amount that applies to your subscription.
For the most current subscription information, please refer to the applicable App Store product page at the time of purchase.
9.4 Automatic Renewal
Unless cancelled, subscriptions automatically renew at the end of each billing period.
Apple will charge your chosen payment method within the timeframe specified by Apple before renewal.
Your subscription continues until cancelled.
9.5 Managing or Cancelling Your Subscription
Subscriptions may be managed or cancelled through your Apple ID account settings.
To avoid renewal charges, you must cancel your subscription before the applicable renewal deadline established by Apple.
Deleting the app from your device does not automatically cancel your subscription.
9.6 Free Trials and Introductory Offers
Some subscriptions may include free trials or introductory offers.
Eligibility for such offers is determined by Apple and may depend on factors such as your Apple account and previous subscriptions.
Unless cancelled before the applicable trial period ends, your subscription automatically converts into a paid subscription under Apple's billing process.
9.7 Refunds
All purchases are processed by Apple.
Refund requests are generally governed by Apple's refund policies.
Storm Advies B.V. cannot approve or issue refunds for purchases processed through Apple's App Store.
9.8 Subscription Changes
We may introduce new subscription plans, modify existing features or discontinue subscription offerings from time to time.
Where required by law or Apple's policies, appropriate notice will be provided before material changes take effect.
10. User Content
10.1 Ownership of Your Content
You retain ownership of all memories, notes, journal entries, photographs, quotes, conversations and other content that you create using the Spark Rituals apps.
Nothing in these Terms transfers ownership of your personal content to Storm Advies B.V.
10.2 Local Storage
Your content remains stored on your own Apple device and, where enabled, within your personal iCloud account.
Because of the local-first architecture of the apps:
we generally cannot access your content;
we do not review your memories;
we do not analyse your journal entries;
we do not use your content for advertising;
we do not sell your content; and
we do not use your content to train artificial intelligence or machine learning models.
10.3 Responsibility for Your Content
You are solely responsible for the content that you choose to create, store or export.
You represent that:
you have the right to create and store your content;
your use of the apps complies with applicable laws;
your content does not infringe the rights of others; and
you will not knowingly use the apps for unlawful purposes.
10.4 Backups
You are responsible for maintaining appropriate backups of your information.
Although Apple may synchronise your content through iCloud if enabled, Storm Advies B.V. does not guarantee that backups will always be available or recoverable.
11. Acceptable Use
You agree to use the Spark Rituals apps responsibly and in accordance with applicable laws.
You agree that you will not:
use the apps for any unlawful purpose;
interfere with the operation or security of the apps;
attempt to gain unauthorised access to any systems associated with the apps;
reverse engineer or attempt to extract the source code except where permitted by law;
distribute malware, viruses or other harmful code;
misuse the apps in a manner that disrupts other users;
use the apps to infringe the intellectual property rights or privacy rights of others;
impersonate another person or organisation; or
use the apps in a manner that violates these Terms.
If we reasonably believe that your use of the apps violates these Terms or applicable law, we may suspend or terminate your right to use the apps.
12. Intellectual Property Rights
The Spark Rituals apps, including their software, design, layout, graphics, logos, trademarks, text, visual elements and other materials, are owned by or licensed to Storm Advies B.V. and are protected by applicable intellectual property laws.
Except for your own User Content, all intellectual property rights in the apps remain the exclusive property of Storm Advies B.V. or its licensors.
You may not copy, reproduce, modify, distribute, publicly display or commercially exploit any part of the apps except as expressly permitted by these Terms or by applicable law.
"Spark Rituals," "Little Lines," "Stay Close," "Daily Talk" and any associated logos, names or branding are trademarks or trade names of Storm Advies B.V. or are used under licence. You may not use them without our prior written permission.
13. Privacy
Your privacy is one of the core principles of Spark Rituals.
Our handling of personal information is described in our Privacy Policy, which forms an integral part of these Terms.
By using the apps, you acknowledge that you have read and understood our Privacy Policy.
Because the apps are designed using a local-first architecture, most of the information you enter remains on your own Apple device or within your personal iCloud account and is not collected by Storm Advies B.V.
Where we receive limited information, such as customer support communications or subscription status information provided by Apple, we process that information in accordance with our Privacy Policy and applicable law.
14. Disclaimer – Educational and Informational Purposes Only
Spark Rituals is designed to encourage meaningful family interactions, preserve memories and provide tools that parents may find helpful in their daily lives.
Our apps have been developed with input from a child psychologist and informed by child development principles. However, the apps are intended solely for general educational, informational and personal use.
The apps do not provide:
medical advice;
psychological advice;
psychiatric advice;
counselling services;
therapy;
parenting instructions;
educational assessments;
crisis intervention; or
professional healthcare services.
Nothing contained within the apps should be interpreted as a substitute for advice from a qualified physician, psychologist, psychiatrist, therapist, educator or other licensed professional.
Every child develops differently, and every family's circumstances are unique. Decisions concerning a child's health, education, wellbeing or development should always be made in consultation with appropriately qualified professionals.
If you believe that you or your child may be experiencing a medical or mental health emergency, contact the appropriate emergency services or a qualified healthcare provider immediately.
Your use of the apps is entirely voluntary and at your own discretion.
15. Availability of the Apps
We aim to make the Spark Rituals apps available on a reliable basis.
However, we do not guarantee that the apps will always be available, uninterrupted or free from errors.
From time to time we may:
perform maintenance;
release updates;
introduce new features;
modify existing functionality;
suspend access for maintenance or security reasons; or
discontinue certain features or services.
We will use reasonable efforts to minimise disruption where practicable, but we are not liable for temporary interruptions or unavailability.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable law.
To the fullest extent permitted by law, Storm Advies B.V., its directors, officers, employees, contractors, affiliates and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising out of or relating to:
your use of, or inability to use, the apps;
loss of data;
loss of memories or exported files;
loss of profits;
business interruption;
emotional distress;
loss of goodwill; or
any other indirect or consequential loss.
Because Spark Rituals does not control your Apple device, your iCloud account or Apple's services, we are not responsible for losses resulting from:
deletion of content from your device;
deletion of content from your iCloud account;
Apple service interruptions;
Apple account issues;
device failures;
hardware failures;
software conflicts;
unauthorised access to your Apple ID caused by your own failure to protect your credentials; or
failures of third-party services outside our reasonable control.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the use of the apps shall not exceed the greater of:
(a) the total amount you paid to Storm Advies B.V. through Apple for the applicable app during the twelve (12) months immediately preceding the event giving rise to the claim; or
(b) EUR €100.
Some jurisdictions do not permit certain liability limitations. Where such laws apply, portions of this section may not apply to you.
17. Indemnification
You agree to indemnify, defend and hold harmless Storm Advies B.V., its directors, officers, employees, contractors, affiliates and licensors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or relating to:
your breach of these Terms;
your unlawful use of the apps;
your infringement of another person's rights;
your User Content; or
your violation of any applicable law.
This obligation continues after your use of the apps ends.
18. Suspension and Termination
We may suspend or terminate your licence to use the apps immediately if we reasonably believe that:
you have materially breached these Terms;
your use of the apps is unlawful;
your use presents a security risk;
continued access could expose us or other users to harm; or
we are required to do so by law.
You may stop using the apps at any time by uninstalling them from your device.
If you purchased a subscription, cancelling your subscription must be completed through your Apple account. Uninstalling the app alone does not cancel your subscription.
Termination of these Terms does not affect any rights or obligations that arose before termination.
Sections that by their nature should survive termination—including those relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution—will continue to apply.
19. Updates to the Apps and these Terms
We may update the apps and these Terms from time to time to:
improve functionality;
address security issues;
comply with changes in applicable law;
reflect changes to our services; or
introduce new features.
When material changes are made to these Terms, we will update the "Last Updated" date shown at the beginning of this document.
Where required by applicable law, we will provide additional notice before material changes take effect.
Your continued use of the apps after updated Terms become effective constitutes your acceptance of the revised Terms, unless applicable law requires a different form of consent.
20. Governing Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of the Netherlands, without regard to its conflict of law principles.
If a dispute arises, the parties agree to first attempt to resolve the matter through good-faith discussions.
If the dispute cannot be resolved informally, it shall be submitted to the competent courts of the Netherlands, unless mandatory consumer protection laws require that proceedings may be brought in another jurisdiction.
Nothing in these Terms limits any mandatory rights available to consumers under applicable law.
21. Miscellaneous
21.1 Entire Agreement
These Terms, together with our Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between you and Storm Advies B.V. regarding your use of the apps.
21.2 Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
21.3 No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.
21.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms, including in connection with a merger, acquisition, corporate restructuring or sale of our business or assets, provided that such transfer does not materially reduce your legal rights.
21.5 Electronic Communications
You agree that communications relating to the apps and these Terms may be provided electronically, including through the apps, our website or email where applicable.
Electronic notices will have the same legal effect as written notices.
21.6 Force Majeure
We are not responsible for delays or failures to perform caused by events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, labour disputes, internet outages, failures of Apple's services or other events that could not reasonably have been prevented.

23. Apple-Specific Acknowledgement
You acknowledge that:
these Terms are concluded solely between you and Storm Advies B.V., and not with Apple;
Apple is not responsible for the Spark Rituals apps or their content except as required by applicable law;
Apple has no obligation to furnish maintenance or support services for the apps;
Apple may enforce these Terms as a third-party beneficiary where applicable under Apple's App Store requirements.
